Terms and Conditions for Electronic Bill (e-Bill) Delivery to Home Banking and Bill Payment Web Sites

Customer Requirements

You may activate electronic delivery of your SDG&E bill (to your home banking/bill payment web site of choice if you are a customer of San Diego Gas & Electric Company (“SDG&E”) and have requested e-Bill activation from your home banking/bill payment web site. This type of bill is referred to herein as “e-Bill”. If you have more than one account with SDG&E, you will need to activate each account separately for e-Bill delivery. You do not have to enroll in SDG&E’s My Account to receive e-Bills. If you do enroll in My Account, these terms and conditions are additional to and do not replace SDG&E’s My Account Terms and Conditions-Online Account Management Usage Agreement (“My Account Agreement”). In the event of any conflict, however, between the My Account Agreement and these terms and conditions, these terms and conditions shall control as to their subject matter.

Upon SDG&E’s acceptance of your e-Bill activation request from your home banking/bill payment web site, SDG&E will deliver your bill electronically to the web site from which you initiated the e-Bill delivery activation.

Upon being activated to receive SDG&E e-Bills at your home banking/bill payment web site, you will no longer receive SDG&E bills, either directly from SDG&E via e-mail or through the U.S. mail, for any SDG&E account(s) you have activated. Notices regarding your service and SDG&E’s business, rates and other operations will be identified and provided to you only if you choose to view your detailed bill through the e-Bill portal on your home banking/bill payment website.

SDG&E reserves the right to modify or discontinue any or all services or features of the e-Bill delivery program at any time without notice, or to offer specific programs only to customers meeting applicable qualifications. Subject to satisfying the qualifications for a particular program, you may elect to use one or more of the features available without being obligated to use them all.

By activating SDG&E e-Bills from your home banking/bill payment web site, you agree to be and are subject to these terms and conditions (or any future modification thereof), as a pre-condition to receiving SDG&E e-Bills at your home banking/ bill payment web site.

e-Bill due E-mail notification

Your home banking/ bill payment web site controls the “bill due” e-mail notification process that will inform you when it has received an SDG&E e-Bill to be viewed and/or paid. You are responsible for paying your SDG&E bill(s) on a timely basis regardless of whether or not you receive an e-Bill or your home banking/bill payment web site’s “bill due” e-mail notification(s). SDG&E will forward any shut-off notices, due to non-payment of bills, through the U.S. mail.

Deactivate receiving SDG&E e-Bills at your home banking/bill Payment web site

To discontinue receiving SDG&E e-Bills at your home banking/bill payment web site you must deactivate this feature at the same home banking/bill payment web site where you first activated it.

Other Terms and Conditions

SDG&E will not charge you to receive e-Bills at your home banking/bill payment web site. Although SDG&E will not impose any charges for your receipt of e-Bills, you are solely responsible for the accuracy of your current banking information and for payment of any charges imposed by your bank or financial institution as a result of your receipt and/or use of e-Bills. In addition, if your payment is ever rejected, SDG&E will pass through the charges assessed for such rejection, and will add an $8.00 returned payment fee on your next bill. You may view and pay your bill account(s) online through other web sites and payment services; however they may charge a fee for this service. Additionally, you are responsible for any Internet service fees that may be assessed by your telephone and/or Internet service provider.

SDG&E does not control posting times for payments made through your home banking/bill payment web site. Please follow the instructions on such web site as to posting date and times.

During e-Bill activation you may be provided the option to receive occasional e-mails from SDG&E containing news, useful information or special offers. This option may be accepted or rejected by selecting/unselecting it at your home banking/bill payment web site e-Bill related screen(s).

SDG&E has no responsibility for any failure or error in delivering e-Bills to your home banking/bill payment web site, including without limitation any interruption, omission, mistake, malfunction or delay related thereto. No indirect, consequential, punitive or special damages may be claimed, awarded or assessed against SDG&E in connection with e-Bill delivery. SDG&E reserves the right in its sole opinion to bar any user from receiving an SDG&E e-Bill at any home banking/bill payment web site.

E-Bill delivery will be operated and used at all times subject to applicable laws, rules, regulations and decisions of federal and state governmental authorities having jurisdiction, as in effect from time to time, including without limitation the Public Utilities Commission of the State of California.

Any dispute related to e-Bill delivery shall be resolved pursuant to the laws of the State of California, without reference to its principles on conflicts of laws.

Your use of e-Bill delivery does not provide any legal right or interest in any intellectual property of SDG&E used in connection therewith, or derived therefrom, or any text or other content posted in connection therewith, including without limitation any copyright, for which all rights are reserved by SDG&E.

Use of e-Bill delivery, and any SDG&E service accessed, is at your sole risk. Although SDG&E has endeavored to create a secure and reliable service, the confidentiality of any communication transmitted over the Internet cannot be guaranteed. Accordingly, SDG&E and its parent and affiliates are not responsible for the security of any information transmitted or accessed using the Internet. Actual or attempted unauthorized use of this service may result in criminal and/or civil prosecution.
